Terms & Conditions

Please read these Terms & Conditions carefully. By creating an account, ticking the acceptance box, or using SmoothSeas, you agree to be bound by these Terms. If you do not agree, do not create an account or use the service.

1. Who these terms are between

These Terms & Conditions ("Terms") are a binding agreement between you, the parent or legal guardian creating and controlling the account ("you", "Guardian"), and SmoothSeas ("SmoothSeas", "we", "us", "our"), operated by 64-Bit Software Solutions, of 180 Upper 7th Avenue, Malick, Barataria, the Republic of Trinidad and Tobago. Together with our Privacy Policy, they govern your and your child's use of the SmoothSeas website, applications, and related services (the "Service").

2. Eligibility and authority

  • You confirm that you are at least 18 years of age.
  • You confirm that you are the parent or legal guardian of each child you add, and that you have the authority to consent to these Terms and to our processing of that child's information on the child's behalf.
  • You are responsible for all activity under your account and for your child's use of the Service.
  • The Service is intended to be used by children only under your supervision and control.

3. What SmoothSeas is — and is not

SmoothSeas is a supplementary educational tool that helps children prepare for the Secondary Entrance Assessment (SEA) and build study habits. It provides lessons, practice, diagnostics, pacing, progress reporting, and motivational features.

SmoothSeas is a study aid only. It is not a school, a tutor, an examination body, or a guarantee of any result. We do not promise, warrant, or guarantee any particular SEA score, placement, grade, academic outcome, or admission to any school. Estimates, projections, and "readiness" indicators are informational only, are based on the limited information available to us, and must not be relied upon as a prediction of actual examination results.

4. Accounts and security

  • You must provide accurate, current, and complete information when registering, including a valid email address and, where requested, a phone number, and keep it up to date.
  • You are responsible for keeping your login credentials — and any credentials you create for a child — confidential, and for all activity that occurs under them.
  • You must notify us promptly of any unauthorised use of your account at hello@smoothseas.org.
  • We may verify your email and phone number (for example by a link, a code, or a WhatsApp/SMS message) and may use trusted third parties to do so.

5. Children and their information

You acknowledge and agree that:

  • Child profiles are created and controlled by you, and any information you provide about a child is provided with your consent as the child's Guardian.
  • We collect and process a child's information only to provide and improve the Service, as described in our Privacy Policy, and in accordance with applicable data-protection law, including the Data Protection Act of the Republic of Trinidad and Tobago to the extent in force.
  • You may review, correct, or request deletion of your child's information, and may close the account, as described in our Privacy Policy.
  • You are responsible for supervising your child's use of the Service and for deciding what is appropriate for your child.

6. Acceptable use

You agree that you and your child will not:

  • use the Service for any unlawful, harmful, or fraudulent purpose;
  • share, sell, or transfer account access, or create an account for anyone other than a child in your care;
  • attempt to access, probe, or disrupt the Service, its servers, or its security, or to reverse engineer, scrape, or copy it except as permitted by law;
  • upload or transmit anything unlawful, infringing, abusive, or that contains malware;
  • interfere with any other user's use of the Service, or misuse the messaging, chat, or content-feedback features.

We may suspend or terminate access for any breach of this section.

7. Fees, subscriptions, and payments

Some features of the Service may be free and others may require a paid subscription or one-off payment. Where fees apply, the price, billing period, and renewal terms will be shown to you before you pay. Unless required by law or stated otherwise at the point of sale, payments are non-refundable, and you authorise us and our payment processors to charge the payment method you provide. We may change our fees on reasonable notice; changes will not affect a billing period you have already paid for.

8. Virtual items and in-app rewards

The Service includes motivational features such as streaks, perks, ranks, and a cosmetic economy using an in-app currency ("Doubloons") and cosmetic items. You acknowledge that:

  • Doubloons, perks, ranks, and cosmetic items have no monetary value, are not property, and cannot be exchanged for cash or transferred outside the Service;
  • they are licensed to you for use within the Service only, are non-refundable, and may be adjusted, expired, or discontinued at our discretion;
  • they are earned through use of the Service and are never sold for real money.

9. Intellectual property

The Service, including its lessons, questions, text, graphics, the "Smooth" character, logos, software, and design, is owned by SmoothSeas or its licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Service for the personal, non-commercial educational use of the children in your care. You may not reproduce, distribute, publicly display, or create derivative works from the Service except as expressly permitted.

10. Your content and feedback

You and your child may submit content such as writing, answers, uploads, and messages ("User Content"). You retain ownership of User Content, and you grant us a worldwide, royalty-free licence to host, process, and display it as needed to operate and improve the Service. You are responsible for User Content and confirm you have the right to submit it. Any feedback or suggestions you give us may be used by us without obligation to you.

11. Third-party services

The Service relies on third-party providers (for example for messaging, email delivery, anti-abuse verification, hosting, and AI-assisted features). Your use may be subject to their terms, and we are not responsible for third-party services, content, or websites we link to. AI-generated feedback and summaries may contain errors and are provided for guidance only.

12. Privacy

Our collection and use of personal information — including special protections for a child's information — is described in our Privacy Policy, which forms part of these Terms. By using the Service you consent to that processing.

13. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any content, estimate, or projection is accurate or will produce any particular educational result.

14. Limitation of liability

To the maximum extent permitted by law, SmoothSeas and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or educational opportunity, arising out of or relating to your or your child's use of, or inability to use, the Service. To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Service will not exceed the greater of the amounts you paid to us in the twelve (12) months before the event giving rise to the claim, or one hundred United States dollars (US$100). Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

15. Indemnification

You agree to indemnify and hold harmless SmoothSeas and its officers, employees, and suppliers from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your or your child's use of the Service, your User Content, or your breach of these Terms or of any law or third-party right.

16. Suspension and termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms, if we are required to by law, or if we discontinue the Service. On termination, your right to use the Service ends; sections that by their nature should survive (including sections 8–15 and 17–18) will survive.

17. Changes

We may modify the Service or these Terms from time to time. If we make material changes to these Terms, we will take reasonable steps to notify you (for example by email or in-app) and may ask you to accept the updated Terms. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

18. Governing law and disputes

These Terms are governed by the laws of the Republic of Trinidad and Tobago, without regard to conflict-of-law rules. You agree to the exclusive jurisdiction of the courts of the Republic of Trinidad and Tobago for any dispute arising out of or relating to these Terms or the Service, subject to any mandatory consumer-protection rights you may have.

19. General

These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service. If any provision is held unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to an affiliate or successor. We are not liable for failure or delay caused by events beyond our reasonable control.
